1. Agreement to Terms

By accessing or using Emberly's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Service

Emberly, operated by Think Do OÜ, provides documentary creation services that transform personal interviews and conversations into cinematic video documentaries. Our services include:

  • Professional video recording of interviews
  • Post-production editing and enhancement
  • Delivery of finished documentary content

3. User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information
  • Obtain necessary consents from all individuals appearing in recordings
  • Not use our services for any unlawful purpose
  • Respect intellectual property rights
  • Maintain the confidentiality of any account credentials

4. Intellectual Property

Upon full payment, you receive a license to use the final documentary for personal, non-commercial purposes. Think Do OÜ retains the right to use anonymized or consented excerpts for promotional purposes unless otherwise agreed in writing.

All Emberly branding, website content, and proprietary methods remain the exclusive property of Think Do OÜ.

5. Payment Terms

Payment terms will be outlined in your service agreement. Unless otherwise specified:

  • A deposit may be required to commence work
  • Final payment is due upon delivery of the completed documentary
  • All fees are non-refundable once production has begun

6. Cancellation and Refunds

Cancellation requests must be made in writing. Refund eligibility depends on the stage of production:

  • Before recording: Full refund minus administrative fees
  • After recording begins: Partial refund at our discretion
  • After delivery: No refunds

7. Limitation of Liability

To the maximum extent permitted by law, Think Do OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Think Do OÜ and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Estonia.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
